August 2016 - Following argument in the U.S. Court of Appeals for the Second Circuit, ML achieved a settlement in a mortgage-backed securities case that had been dismissed in the district court as time barred and failing to state a claim. Our team was hired to handle the matter on appeal and enabled investors to recover on claims that had been dismissed. Read more here.
August 2016 - The First Department of the New York Supreme Court Appellate Division issued a key ruling favoring RMBS investors represented by the firm. The decision allows a plaintiff to bring an independent claim for failure to notify other parties to a securitization of breaches of representations and warranties. It also holds that gross negligence can be a bar to the invocation of a limitation of liability clause. Read the opinion here.
