Swara Saraiya

Swara Saraiya’s practice focuses on a broad range of business disputes—including antitrust, contract, fraud, and intellectual property matters—in arbitral forums, as well as trial and appellate courts.

As a skilled advocate, Ms. Saraiya contributes to every stage of the case—conducting in-depth factual and legal research, drafting motions, managing all aspects of discovery, and preparing for trial.

Ms. Saraiya has briefed federal appeals before the First, Second, and Federal Circuits that involved expansive records and complex legal issues, including patent, securities, and administrative law. She has also litigated before the U.S. Supreme Court.

Prior to joining MoloLamken, Ms. Saraiya served as a law clerk to the Honorable Wendy Beetlestone of the United States District Court for the Eastern District of Pennsylvania. She also previously worked as a litigation associate at Cravath, Swaine & Moore LLP.

  • Representing multinational telecommunications company challenging a $150 million+ jury verdict of patent infringement in appeal to the Federal Circuit
  • Representing foreign company in complex attachment and judgment enforcement proceedings in the Southern District of New York
  • Representing a group of student athletes objecting to the $2.576 billion settlement of an antitrust suit against the NCAA over athlete compensation
  • Representing an inventor of magnetic material against leading hard-drive maker in a patent infringement appeal to the Federal Circuit
  • Representing lighting company challenging a $20 million+ jury verdict of patent infringement appeal to the Federal Circuit 
  • Representing Inventors Defense Alliance as amicus curiae in support of neither party in EcoFactor, Inc. v. Google LLC (Fed. Cir.)
  • Represented a Japanese medical device manufacturer in a breach of contract suit against a multinational medical technology company
  • Represented an investment fund in breach-of-contract and fraud suit involving a portfolio of life insurance policies in the Southern District of New York
  • Represented holders of residential mortgage-backed securities in an appeal over the distribution of a multi-billion-dollar settlement fund in New York state court
  • Represented university and exclusive licensee in successful defense of standing in patent infringement suit against Amazon
  • Represented company as issues and appeals counsel in suit to obtain just compensation for the taking of property through eminent domain by the National Railroad Passenger Corporation (Amtrak)
  • Represented a regional transmission organization in opposition to a temporary restraining order in state court
  • Represented luxury brand in assessment of potential trademark
  • Represented a major utility company in connection with complex federal, state, and bankruptcy proceedings relating to California wildfires from discovery through pretrial preparation
  • Represented a global pharmaceutical company in antitrust litigation in the Southern District of New York involving a patent settlement for a blockbuster antihypertensive drug
  • Represented the Brennan Center for Justice as amicus curiae in Carney v. Adams, 141 S.Ct. 493 (2020)
  • Represented gun violence scholars as amici curiae in Everytown for Gun Safety v. Bureau of Alcohol, Tobacco and Firearms, 984 F.3d 30 (2d. Cir 2020)
  • Represented the Advocates for Human Rights in connection with an amicus brief submitted to the U.S. Attorney General in support of Respondent in Matter of A.M.R.C.
